Please read these Terms of Service carefully before using DragSwap.

  1. Interpretation and Definitions For the purposes of these Terms of Service: Account means a unique account created for You to access DragSwap or parts of our Service. Application means the DragSwap platform accessible at dragswap.com. Buyer refers to users of the Service who are placing Orders for Goods. Company (referred to as "We", "Us" or "Our") refers to DragSwap, operated by ShowcaseDrag, United States. Content refers to text, images, or other information that can be posted, uploaded, or otherwise made available by You on DragSwap. Device means any device that can access the Service such as a computer, cell phone, or tablet. Good refers to the items offered for sale on DragSwap including costumes, wigs, makeup, padding, shoes, accessories, and props. Operator refers to DragSwap, operated by ShowcaseDrag. Order means a request by You to purchase Goods on DragSwap. Seller refers to users of the Service who are listing Goods for sale. Service refers to the DragSwap website accessible at dragswap.com. Terms of Service means these Terms that form the entire agreement between You and DragSwap regarding use of the Service. You means the individual accessing or using DragSwap.

  3. Acknowledgment These Terms govern the use of DragSwap and the agreement between You and DragSwap. By accessing or using DragSwap You agree to be bound by these Terms. If You disagree with any part of these Terms You may not access the Service. You must be of legal age in your country to use DragSwap. We do not permit those under the age of majority to use the Service. Your use of DragSwap is also conditioned on Your acceptance of our Privacy Policy. Please read it carefully before using the Service.

  4. Governing Law The laws of the United States, excluding its conflicts of law rules, shall govern these Terms and Your use of DragSwap. Your use of the Service may also be subject to other local, state, or federal laws.

4.1 United States Legal Compliance You represent and warrant that You are not located in a country subject to a United States government embargo and are not listed on any United States government list of prohibited or restricted parties.

4.2 Severability If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law. The remaining provisions will continue in full force and effect.

4.3 Waiver The failure to exercise a right or require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter.

  1. User Accounts

5.1 Account Creation When You create an account with DragSwap, You must provide accurate, complete, and current information at all times. Failure to do so may result in immediate termination of Your account. You may not use a username that impersonates another person, infringes on any trademark or rights, or is offensive, vulgar, or obscene.

5.2 Account Information You may be asked to provide Your name, email, phone number, address, and drag name. Before listing Goods for sale, You may be asked to provide bank account details for payouts. Before placing an Order, You may be asked to provide payment card details and shipping information.

5.3 Account Review DragSwap does not perform background checks or endorse any users. We do not accept responsibility for the reliability, accuracy, or completeness of any information provided by users.

5.4 Account Password You are responsible for safeguarding Your password and for all activities that occur under Your account. You must notify Us immediately at dragswapco@gmail.com if You become aware of any unauthorized use of Your account.

5.5 Account Termination We may terminate or suspend Your account immediately, without prior notice, for any reason including breach of these Terms. If You wish to terminate Your account, contact Us at dragswapco@gmail.com.

  1. Content

6.1 Your Right to Post Content DragSwap allows You to post listings, photos, descriptions, and reviews. You are responsible for all Content You post, including its legality, accuracy, and appropriateness. By posting Content to DragSwap, You grant Us the right to use, display, reproduce, and distribute that Content on and through the Service. You retain all ownership rights to Your Content.

6.2 Content Restrictions You may not post Content that is unlawful, offensive, threatening, defamatory, discriminatory, or otherwise objectionable. This includes but is not limited to: Content promoting unlawful activity Discriminatory content targeting any group based on race, sexual orientation, gender, religion, or national origin Spam or unauthorized advertising Content containing malware or viruses Content that infringes on any intellectual property rights Impersonation of any person or entity False or misleading information about Goods

DragSwap reserves the right to remove any Content that violates these Terms at its sole discretion.

6.3 Intellectual Property We respect the intellectual property of others. If You believe Content on DragSwap infringes Your copyright, contact Us at dragswapco@gmail.com with a description of the work, the location of the infringing content, Your contact details, and a statement that You have a good faith belief the use is not authorized.

  1. Orders of Goods

7.1 Position of DragSwap in Orders DragSwap acts as a facilitator between Buyers and Sellers. We are a third party in Orders and our liability in any dispute between Buyers and Sellers is limited accordingly. Any agreement You enter with a Seller does not form part of any agreement We have with You.

7.2 Buyer Information To place an Order You may be asked to provide Your name, email, payment card details, billing address, and shipping information. You represent and warrant that You have the legal right to use any payment method You provide and that all information You supply is true, correct, and complete.

7.3 Availability and Accuracy DragSwap and its Sellers cannot guarantee the accuracy of all listing information including prices, images, and availability. We reserve the right to correct errors or update information at any time without prior notice.

7.4 Prices Sellers set their own prices on DragSwap. Prices may be revised prior to an Order being accepted. If a price changes after Your Order, You will have the right to cancel.

7.5 Payments All payments on DragSwap are processed securely through Stripe. Payment cards are subject to validation and authorization by Your card issuer. DragSwap is not liable for any delay or non-delivery resulting from failed payment authorization.

7.6 Service Fees DragSwap charges a 15% commission on all completed sales. This fee is deducted automatically from the Seller's payout. DragSwap reserves the right to change its service fees at any time with reasonable notice.

7.7 Order Cancellation by Buyers If You as a Buyer cancel an Order, the amount You paid including service fees is not refunded. If You believe Your Order should be refunded due to exceptional circumstances, contact Us at dragswapco@gmail.com.

7.8 Order Cancellation by Sellers If You as a Seller cancel an Order, the amount the Buyer paid will be refunded in full to the Buyer and will not be transferred to the Seller.

7.9 Shipping Sellers are responsible for shipping items promptly after a sale is completed. DragSwap strongly recommends using tracked shipping on all orders. DragSwap is not liable for items lost or damaged in transit.

7.10 Order Disputes If a Buyer or Seller disputes an Order, contact Us at dragswapco@gmail.com. All disputes will be reviewed and resolved at DragSwap's sole discretion. Once a Buyer confirms receipt or the review window closes, all sales are final.

  1. Disclaimer of Warranties and Limitation of Liability

8.1 Limitation of Liability The entire liability of DragSwap under any provision of these Terms shall be limited to the amount actually paid by You through the Service or 100 USD if You have not purchased anything through the Service. To the maximum extent permitted by applicable law, DragSwap shall not be liable for any special, incidental, indirect, or consequential damages including loss of profits, loss of data, or business interruption arising out of Your use of or inability to use the Service.

8.2 Service Provided As Is DragSwap is provided to You on an AS IS and AS AVAILABLE basis without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8.3 Third Party Links DragSwap may contain links to third party websites. We have no control over and assume no responsibility for the content or practices of any third party sites. We strongly advise You to read the terms and privacy policies of any third party sites You visit.

  1. Disputes Resolution If You have any concerns or disputes about DragSwap, You agree to first try to resolve the dispute informally by contacting Us at dragswapco@gmail.com.

  2. Intellectual Property of DragSwap DragSwap and its original content, features, and functionality are and will remain the exclusive property of DragSwap and ShowcaseDrag. The DragSwap name, logo, and trademark may not be used in connection with any product or service without Our prior written consent.

  3. Your Feedback You assign all rights, title, and interest in any feedback You provide to DragSwap. If for any reason such assignment is not effective, You agree to grant DragSwap a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use and exploit such feedback without restriction.

  4. Changes to These Terms We reserve the right to modify these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days notice before new terms take effect. By continuing to use DragSwap after revisions become effective, You agree to be bound by the updated Terms. If You do not agree to the new Terms, please stop using DragSwap.
